Prenuptial Agreement / Real Property Acquired
Once the parties are married, there
is the issue of newly acquired real property. Quite
often, the parties acquire real property together.
Depending on where the funds come from for any down payment
and whose income is being used to pay the new mortgage payments,
or if the mortgage is being paid from a prenuptial agreement
or community property account to which both contribute
a predetermined amount, that real property and its
separate property or community property status,
etc., is planned for in the Prenuptial Agreement.
